Terms of Service

Plan My Costa Rica (“we”, “us”, or “the Site”) is a booking-facilitation platform operated from Costa Rica. We publish curated listings of tours, activities, and travel services offered by independent third-party operators. By accessing or using planmycostarica.com you agree to be bound by these Terms of Service (“Terms”).

We act solely as a booking agent and marketplace between travelers (“you”) and independent tour operators, transportation providers, rental agencies, and other suppliers (each a “Supplier”). We are not the operator, organizer, carrier, or provider of any tour, transport, lodging, rental, or other service listed on the Site.

When you complete a booking, a contract is formed directly between you and the applicable Supplier. Plan My Costa Rica is not a party to that contract. The Supplier is solely responsible for delivering the service, for safety, for staffing and equipment, for insurance, and for compliance with all applicable Costa Rican and international laws.

We are not a tour operator, “operador turístico”, or “agencia de viajes” as defined under Costa Rican regulation. We do not sell packaged travel arrangements at an inclusive price. Where multiple services are booked together, they remain separate contracts with their respective Suppliers.

We list only Suppliers that represent to us that they are:

• Registered and in good standing with the Instituto Costarricense de Turismo (ICT) where required by Costa Rican law;
• Holders of the civil-liability and adventure-tourism insurance required by ICT and by Decreto Ejecutivo N.º 36389-MEIC-TUR and related regulations;
• In compliance with local safety, licensing, environmental, and labor requirements applicable to their activity;
• Truthful and accurate in the descriptions, pricing, inclusions, and safety information supplied to us.

Plan My Costa Rica performs commercially reasonable review of Suppliers before listing them, but does not independently audit, certify, or guarantee their continued compliance. Suppliers indemnify Plan My Costa Rica against any loss arising from their breach of these obligations.

You are responsible for:

• Ensuring that every traveler in your booking is physically and medically fit to participate in the chosen activity, including any minimum-age, health, pregnancy, and swimming requirements listed on the tour page;
• Reading and following all safety instructions, briefings, and rules given by the Supplier;
• Carrying valid travel and medical insurance, which we strongly recommend for all adventure activities;
• Providing accurate contact and traveler information at the time of booking;
• Arriving on time and at the correct meeting point.

Prices are quoted in United States dollars unless otherwise stated and may be subject to sales tax (IVU) and local fees. The applicable cancellation, refund, and rescheduling policy is set by each Supplier and displayed on the tour page. Refund requests are processed by the Supplier; we assist with communication as a courtesy.

Suppliers may cancel or reschedule for safety reasons, weather, force majeure, or insufficient bookings. In such cases the Supplier’s cancellation policy applies.

Many activities listed on the Site — including rafting, canyoneering, zip-lining, hiking, ATV riding, horseback riding, surfing, snorkeling, and diving — carry inherent risks of personal injury, illness, property damage, and, in rare cases, death. By booking, you acknowledge those risks and voluntarily accept them on behalf of yourself and every traveler in your party.

To the maximum extent permitted by applicable law, Plan My Costa Rica, its owners, employees, and contractors are not liable for any loss, injury, death, illness, delay, damage, theft, expense, or dispute arising from or in connection with:

• Any act, omission, negligence, or breach by a Supplier;
• The condition of vehicles, equipment, facilities, trails, or premises operated by a Supplier;
• Weather, force majeure, natural disasters, wildlife encounters, strikes, road closures, or acts of government;
• Information provided to us by Suppliers that later proves inaccurate;
• Your failure to follow safety instructions, meeting-point directions, or activity requirements.

Where liability cannot be excluded, our aggregate liability to you for any claim arising from the Site or a booking made through it is limited to the total fees actually paid by you to Plan My Costa Rica (excluding amounts paid to a Supplier) for the specific booking that gave rise to the claim.

Nothing in these Terms limits liability for death or personal injury caused by our own negligence, for fraud, or for any other liability that cannot lawfully be excluded under Costa Rican consumer-protection law (Ley 7472) or the mandatory consumer law of your country of residence.

You agree to indemnify and hold harmless Plan My Costa Rica against any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your conduct during any activity booked through the Site.

All content on the Site — text, images, logos, and layout — is owned by Plan My Costa Rica or its licensors and may not be copied or reproduced without permission. Reviews and photos submitted by travelers may be edited for length and clarity and displayed on the Site.

The Site links to third-party services (for example car-rental partners). Those services are governed by their own terms and privacy policies. We may earn an affiliate commission when you book through those links, at no additional cost to you.

These Terms are governed by the laws of the Republic of Costa Rica. Any dispute arising from these Terms or a booking made through the Site will be submitted to the exclusive jurisdiction of the courts of San José, Costa Rica, without prejudice to any mandatory rights you have as a consumer under the law of your country of residence.

We may update these Terms at any time. The version in force at the time of your booking governs that booking. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
